The ‘cost borne by the trader’: the ban on above cost payment surcharges

Article 19 of the Consumer Rights Directive will place a cap on the fees that traders can charge consumers for using a particular payment method, such as credit or debit cards. This paper considers what might be the most appropriate definition of ‘cost borne by the trader’, and hence what might be the appropriate cap on payment surcharges.
